PEOPLE V DAVID ARIAS

On July 12, 2021 a jury found defendant David Arias, 38, guilty of aggravated sex assault of a child--oral copulation and forcible lewd acts upon a child.

The victim, Jane Doe, was around 11 years old during the time of the continuous sexual abuse, which occurred from June 2017 through April 2019 in Oakland when she was in fifth and sixth grades. Arias had a dating relationship with Doe’s mother and most of the abuse occurred when Doe’s mother was not home.

Arias told Doe not to tell anyone what he was doing to her. Doe said she was afraid of what Arias would do to her mother if she told.

The allegations came to light when Doe disclosed the sexual abuse to a friend at school, who convinced her to tell a school counselor. Police and child protective services were called after Doe reported the information.

The case was prosecuted by DDA Emily Tienken, with aide from Inspector Steve Riley.

Arias is expected to be sentenced on Sept. 30.
