People v Vincente Prado-Rodriguez and Cinthia Gabriel-Martinez

On June 22, 2017, a jury found defendant Vincente Prado-Rodriguez guilty as charged of first degree murder with the use of gun, plus special circumstances for robbery-murder; and robbery with the use of gun. At the conclusion of the presentation of evidence in the trial, Co-Defendant Cinthia Gabriel-Martinez pled guilty to robbery and to being an accessory to the murder.

On May 3, 2015, Vincente Prado-Rodriguez, Cinthia Gabriel-Martinez, and an unknown accomplice robbed victim Cesar Carillo at gunpoint on International Boulevard in Oakland. Defendant Prado-Roridguez pistol-whipped the victim and stole his cell phone and car keys. The unknown accomplice acted as the lookout and Defendant Gabriel-Martinez was the driver.

Fifteen minutes later, the same team robbed victim Basillio Ramirez of his cell phone on 39th Avenue. Defendant Prado-Rodriguez shot victim Ramirez once in the head and once in the chest, killing him.

Oakland Police Department investigated the murder and within 24 hours, OPD had arrested the defendants and. The murder weapon was recovered along with the cell phones of victim Carillo (which was found in Defendant Prado-Rodriguez's pocket) and victim Ramirez (recovered from Defendant Gabriel-Martinez's child's car seat, under her 8-month-old child's leg).

Defendant Prado-Rodriguez faces life without possibility of parole when sentenced in September 2017.

The case was prosecuted by DDA Patrick Moriarty, with assistance from DA Inspector Thomas Milner and Victim-Witness Advocate Stephanie Bernaola, as well as DA forensic video expert Vicki Long.
