People v Edgar Emmanuel Hernandez

On December 7, 2017, a jury found defendant Edgar Emmanuel Hernandez guilty as charged of six counts of oral copulation with a child 10 years of age or younger and three counts of engaging in a lewd act with a child under age 14.

Over the course of many months in 2015, John Doe, when he was just 5 and 6 years old, was repeatedly and regularly sexually abused by Defendant Hernandez. The acts occurred in the victim’s residence in Hayward with Defendant Hernandez having access to the child through his relationship with the victim’s mother. John Doe suffered in silence for many months before eventually disclosing the abuse to his mother on December 30, 2015. John Doe’s mother notified the Hayward Police Department that same day.

The subsequent police investigation included having John Doe interviewed at the CALICO Center in San Leandro in early January 2016. During the interview, John Doe told authorities the details and nature of the abuse. Defendant Hernandez was arrested at his residence in San Jose on January 14, 2016.

John Doe and his mother testified at the jury trial which was held at the East County Hall of Justice. The jury deliberated for less than two hours before returning guilty verdicts on all counts.

Defendant Hernandez is scheduled to be sentenced on February 9, 2018.
