People v Meini Foster

On July 20, 2018, a jury convicted defendant Meini Foster of three forcible sex crimes and found the kidnapping allegations attached to each count to be true.

A night of revelry took a wrong turn when victim Jane Doe, intoxicated and confused, boarded the wrong BART train after a work holiday party and ended up encountering the defendant, who took advantage of the vulnerable victim to move her away from BART and sexually assault her.

Instead of boarding the Pittsburg/Bay Point BART train from San Francisco to get home to her apartment in Walnut Creek, the victim boarded the Dublin/Pleasanton BART train, arriving at that station just after midnight on December 16, 2016. At the Dublin/Pleasanton station, the victim crossed paths with the defendant. BART surveillance video showed the defendant with the victim at the Dublin/Pleasanton station before the two boarded a train to the Bay Fair BART station in San Leandro. The defendant led the victim away from the Bay Fair BART station and into the darkness along railroad tracks that ran between Hesperian Boulevard and Halcyon Drive in San Leandro. The defendant took the victim to a location she did not want to go, against her will, and without her consent. The location was isolated, dark, and muddy. Once at the location, the defendant forcibly committed three sex crimes on Jane Doe. After the sexual assault was over, the defendant left the victim alone in the cold and darkness. The victim walked to a nearby neighborhood and met with police after a concerned neighbor called 911. The victim was covered in mud and had injuries consistent with the assault. DNA evidence later identified the defendant as the assailant.

A jury trial was held at the East County Hall of Justice in Dublin. The jury deliberated for about a day and a half before returning Guilty verdicts on the three completed sex crimes and finding the attached kidnapping allegations to be true. The defendant is scheduled to be sentenced on September 28, 2018.
