People v Spencer Freeman Smith

On 11 September, 2015, defendant Spencer Freeman Smith pled guilty as charged to felony hit-and-run and misdemeanor vehicular manslaughter for hitting and killing a bicyclist in Dublin in 2012. On 25 September, 2015, the judge imposed the sentence of five years of felony probation, one year county jail (1 month in custody, 11 months electronic monitoring), and other standard terms of probation.

The 57-year-old victim, Bo Hu, was riding his bike along Dougherty Road late on May 15, 2012, when he was hit from behind by Defendant Smith in his car. Despite the substantial damage to the front of his car and windscreen, Defendant Smith failed to stop at the scene and continued on home. The victim died as a result of injuries sustained by being hit by Defendant Smith.

During the investigation, the automobile parts found at the scene matched parts missing from Defendant Smith's car and admitted to having hit “a rock, a deer, or something" along Dougherty Road on the evening when Mr Hu was killed. The victim's hair and blood were found on the hood of the car and in the windscreen. Defendant Smith was arrested at his home in San Ramon by Dublin Police a few days later following further investigation.
