Meet DA Nancy E. O'Malley

People v Hien Phouc Nguyen

On October 5, 2015, Defendant Hien Phouc Nguyen was found guilty of felony transportation of marijuana, driving with a suspended license, and simple possession of marijuana.

On February 3, 2015, Defendant Nguyen was traveling along 880 on his motorcycle. He was seen speeding by a CHP officer and was pulled over. As the officer approached Defendant Nguyen, the officer smelled alcohol and an odor of marijuana.

Defendant Nguyen admitted he had been driving at 90-95 miles per hour when he was pulled over, confessed to having 3 beers earlier in the evening, and had smoked a joint within the last few hours. He also admitted to not having a license because it had been suspended, and he also lacked registration and insurance. Defendant Nguyen performed poorly on field sobriety tests and then refused a PAS (breathalyzer) test. Defendant Nguyen was found carrying two pounds of marijuana in his backpack.

Defendant Hien Phouc Nguyen is scheduled to be sentenced on November 3, 2015. The case was tried by DDA Colleen Clark with assistance from DA Inspector Jeff McCort.
