Alameda County District Attorney Nancy E. O’Malley Announces $23.8 Million Settlement with AT&T for Environmental Violations

Alameda County District Attorney Nancy E. O’Malley and Attorney General Kamala D. Harris and today announced a settlement with AT&T to resolve allegations that hundreds of AT&T’s California facilities unlawfully disposed of hazardous waste and material over a nine-year period. As part of the settlement, AT&T will pay $23.8 million. In addition, AT&T will spend an estimated $28 million over the next five years to implement the enhanced environmental compliance measures required by the settlement.The settlement and proposed judgment, filed in Alameda County Superior Court, requires approval from the court before becoming final.

People v Decoy Alcoy Hazle Nov 17, 2014

On November 17, 2014, a jury convicted Decoy Alcoy Hazle of 8 counts of sexual assault of a minor under 10 years of age.

The acts ranged from sexual intercourse of a child under 10, attempted sodomy, oral copulation of a child under 10 and lewd or lascivious acts on a child under 14 years of age. The acts occurred at the defendant’s home in Hayward. The defendant testified that the victim was lying, but the jury found his testimony not credible.

Prosecuting the case was DDA Carrie Skolnick with assistance from Inspector Simon Rhee.

People v Gustavo Moran Nov 12, 2014

On November 12, 2014, a jury convicted defendant Gustavo Moran of the first degree murder of 18-year-old Jesus Diaz. The jury found true the allegation that the defendant personally used a firearm, and additionally convicted him of shooting into an occupied vehicle and assault with a firearm on a 15-year-old girl.

People v Rafael Tovar Nov 3, 2014

On November 3, 2014, a jury convicted Rafael Tovar, 29, of the first degree murder of Justice Afoa, 18, as well as conspiracy to commit murder and found true the allegation that the crime was committed in furtherance of gang activity.
